Module Overview |
The content of the Employment Law module maps onto the Chartered Institute of Personnel and Development (CIPD) Employment Law module and forms part of an integrated programme of study accredited by the CIPD for Graduate membership. The module explores the regulatory framework governing the employment relationship, which emanates from the courts and the European Union, the way this has developed and the impact upon human resource management. |

Module Aims |
To enable the student to:
- Analyse employment law concepts and models
- Apply the relevant principles in the context of rapidly changing business and legal environments
- Understand and appreciate the importance of contemporary developments such as supra-national law-making
To understand the regulatory machinery, systems and processes governing the employment relationship and the sanctions which might be applied for non-compliance |

Learning Outcomes |
- Develop knowledge and understanding of the legal framework, the rules and general principles of common law and statutes of employment law
- Understand the impact of European and International Law on the employment relationship
- Understand the nature, scope and significance of an employer/ employee relationship and the diversity of employment status that now exits in the flexible labour market
- Apply appropriate statutory provisions and common law principles to assess the legal rights and liabilities of employees and employers
- Discuss and critically evaluate the role and functioning of the courts, tribunals and other employment law institutions

- The Legal Framework and Employment Law
- Nature of the employment relationship and the Contract of Employment
- Equality of treatment : sex, race disability and other discrimination and the protection of pregnancy and maternity/ paternity rights
- Regulation of Pay: entitlements to pay and the equal pay provisions
- Health and Safety in the Workplace
- Termination of the contract: common law provisions and unfair dismissal under the provisions of the Employment Rights Act 1996
- Redundancy and the Transfer of Undertakings (Protection of Employment) Regulations( TUPE)
- Employee participation: individual and collective
