Module Overview

The module encourages the development of a critical perspective of matters relating to the law and the institutional framework of the European Union and European Community administrative law.

Module Aims

The aim of the module is to provide an advanced level course in the public (constitutional and administrative) law of the European Union and its context within the framework of other European public law structures.

 

Learning Outcomes

The module encourages the development of a critical perspective of matters relating to the law and integration of the European Union and European Community.

 

 

The course aims to equip the student with the knowledge of the history and structure of the European Union and European Community and understanding of the general principles of the Constitutional and Institutional Law of the EU, focusing on the main concepts of EU constitutionalism and governance, the scope of the EU law and the power relationship between the EU and the Member States’ legal orders.

·             EU Constitutional Law: Concepts and Context

 

·             The Changing Role of an Economic, Social and Political Union

 

·             From the European Coal and Steel Community to the New Reform Treaty

 

·             Institutional Balance: The Horizontal Relationship Between the Community Institutions

 

·             Supremacy, Pre-emption and the Scattered European Constitution

 

·             Subsidiary and Proportionality

 

·             The Evolution of Community Competences and the Phenomenon of “Competence Creep”

 

·             The EU and Democratically Legitimate Governance Beyond the Nation State

 

·             EU Citizenship and Human Rights

 

·             The Constitutional Deadlock of the Stalled EU Constitutional Treaty and the Recent Agreement on the Outlines of a New EU Reform Treaty

 

·             A Core Europe

 

Methods of Teaching/Learning

8 x 3-hour seminars.  The seminars will be interactive and students will be expected to come prepared for the seminar and engage actively in discussions
