Module Aims

The aim is to give students the confidence to make judgements on matters concerning the standard forms of contract used in the construction industry and to deal with the complexity of the conditions of contract.

Learning Outcomes

On successful completion of this study the student should be able to:

 

  • To be able to identify and define the conditions of construction (main and sub) contracts in legal terms to explain duties and obligations of the parties

     

  • To gain the ability to review construction contracts in relation to disputes that occur and critically analyse the limitations of the contract

     

  • To be able to identify, define and apply insurance provisions and use of bonds in construction contracts.

     

  • To be gain knowledge of how to apply third party rights in construction contracts.

     

  • To produce and use information for negotiating and reporting on the conditions of construction contracts in resolving disputes.
  • To be able to analyse problems that occur during the construction process in relation to construction contracts and law
Module Content

A general overview of contract conditions. In depth examination of the ICE Conditions of Contract, JCT Condition of Contract and the Engineering and Construction Contract. Analysis of problem solving in relation to construction contracts.

Methods of Teaching/Learning

30 hours pre-reading, 24 hours lectures, 6 hours tutorials and 90 hours independent learning.

 

Total student learning time 150 hours.
